ALD, RQTH, AAH, disability

Several aids are possible, and the help of the attending physician to make the different files is essential:

• The ALD (long -term assignment) , which allows 100% management by health insurance of any medical expense in connection with meningioma.

• Disability can be declared by social security if the work capacity is estimated reduced by at least 2/3 . It is accompanied by a pension whose amount depends on the disability category.
• The RQTH (recognition of the quality of a disabled worker) is issued by the MDPH (Departmental House of Persons with Disabilities) and notably allows access to postal arrangements or devices dedicated to professional integration.
• AAH , disabled adult allowance.

There are different rights and approaches. Sick leave, disability, ALD, RSA, AAH, RQTH, CMI Priority (inclusive mobility card), CMI parking, etc.
All of this is sometimes difficult to obtain, and depends on the after -effects of operating and/or pain. Hence the central role, essential of the referring doctor, most often the attending physician.

DISABILITY

For employees

"You can be recognized as invalid if your work and gain capacity is reduced by at least 2/3 following an accident or a non -professional disease. You can get the payment of a disability pension in order to compensate for the loss of salary. The invalidity pension is awarded on a provisional basis. This can be revised, suspended or deleted according to the evolution of your situation^⁠ ».

This must be done either by you and your doctor with the sending of the medical certificate attesting to this disability; Either by the medical service advice of your CPAM.

Please note, only people are concerned with an ability to work reduced by 2/3, having worked at least 600 hours in the previous 12 months the stop for disability or contributed "on a salary at least equal to 2,030 times the hourly minimum wage ^⁠ ", being under 62 (see invalidity pension: approaches and care - Ameli )

For civil servants

It is possible to receive a temporary disability allowance (AI) lasting 6 months renewable. This concerns officials who can no longer have sick leave or no longer perceive the IJ.

If the state of health does not improve and the advisory doctor decides to classify this person unfit for work, she will be retired for disability.

Your general practitioner is the only one empowered to make this request. You must therefore put in place with him this procedure which must be made seriously at the risk of being refused the long -term condition. You can turn to the association if you have a refusal.

Long -term affection is a social security system which allows beneficiaries of 100% care for health expenses, without the advance of costs . Condition: Doctors/specialists consulted must be in sector 1, ALD does not cover fee overruns. To do this, you have to get closer to your mutual insurance company.

You have the right to ALD from the moment you suffer from a chronic disease. The severity or height of the impact of the disease is not a criterion, only counts the fact of needing a long -term care protocol. You can benefit from a total reimbursement and third-party payment (not in advance of costs) for all acts which concern the pathology concerned. For example as far as we are concerned: radiology, neurosurgeon, physiotherapy, doctor, treatments.

Another advantage of the ALD: the maintenance of daily allowances in the event of sick leave beyond six months, and the fact that these are non-taxable. Finally, it makes it possible to remove the days of deficiencies with each sick leave. The deficiency period will be retained only for the first work stoppage (valid over a period of 3 years).

The support of your doctor is essential. Your doctor does not have the right to refuse you access to the law, nor to assess the relevance of a request. Sometimes, they are ignorant of the possibility of obtaining ALD. Response deadlines are about three weeks.

The ALD can be obtained for two or five years, it is therefore necessary to apply for renewal when the date of validity is approaching.

NB: To appeal, you can, for only two months from the date of receipt of the refusal notification send a reasoned letter (in receipt) to the amicable appeal commission (CRA) of your health insurance fund. You can reach a letter from your specialist for example, and/or ask your general practitioner for advice. If the use of CRA was rejected , you will have two months again from the date of sending your letter and in the absence of a response from them (yes, no responses from CRA = refusal, they then do not consider it necessary to notify it !!), to seize, the proximity judicial court. You can be assisted by a lawyer by asking for legal aid if you cannot afford it.

Important: endometriosis and ALD, for those affected by endometriosis: the Endomind association has started fundamental work for many months with the government and the Minister of Health in order to officially include endometriosis in the list of diseases that can benefit from ALD . We actively support this approach which will open to better recognition of the disease and will no longer leave the sick in solitude and administrative anxiety. Recognizing your rights should not be one more battle, but a support and relief in daily newspapers already weighed down by the constant management of the disease.

The RSA

If you no longer receive unemployment benefits and you are unable to hold a job, you will need to apply for RSA to CAF.

The procedures have been simplified, but you will have to take into account the follow -up and checks imposed by the department or the metropolis of the place of residential.

MDPH

There is the departmental house for disabled people (MDPH) .
In view of the difficulties encountered when you have one or more meningiomas, operated or not, this request is very important.

The unique MDPH file will allow us to ask:

• recognition of disabled worker (RQTH);
• The inclusive mobility card (CMI) Disability or priority (for transport, wires and public events) and/or parking for disabled. This card also allows you to park for free on any place.
• allocation to disabled adults (AAH);
• The disability compensation service (PCH) which makes it possible to cover additional costs of a human or technical nature linked to the handicap.

  NAMELY 

• As much as the RQTH and the CMI priority are easily attributed to women with meningiomas, operated or not, it is sometimes more complicated for AAH.
• The MDPH file must be sent with a medical certificate of less than 6 months. Your general practitioner must be your ally and must complete this document precisely.
• In the event of AAH refusal, all the appeals must be made, ask to be seen by the advisory doctor. We must not let go, even if our state of health often prevents us from carrying out these approaches.
• You will access the service-public.fr site to certificates of the MDPH file and the medical certificate . You can also recover it at the departmental house or at the house of the metropolis near you.
• Make your requests and if it is refused, make all the appeals. Do not give up, and above all keep all the reports of exams, operations, certificates, etc.
