PREAMBLE
You have taken a progestogy identified at risk of meningioma and you have developed one or more meningiomas: depending on your situation, you may be entitled to start a legal proceedings to request compensation for the damage suffered. This booklet is not intended to say if, in your situation, compensation is possible or not, but to inform what to expect before embarking on a procedure.
In order to be defended as best as possible, and assert your rights, it is preferable to be accompanied by advice, that is to say a lawyer and doctor of victims.
To assert his rights to justice has an obvious financial cost, but he also has a psychological cost (the procedure being long).
It is also necessary to be aware that in France, compensation aims to repair the damage and does not allow the enrichment of the victim to the difference of the United States whose amount of compensation aims, in addition to the repair of the victim, the punishment of the fault (we speak of punitive damage). This explains the important differences in amounts of compensation in France compared to the United States (and which can be seen in American series).
It is important to be well accompanied so that medical expertise takes place in good conditions and has a positive "therapeutic" virtue allowing to understand the disease, its causes, its sequelae but also the failures that have led to this disease.
On the contrary, if it is poorly prepared, the victim will not feel listened to or understood and could conclude that his consequences are not taken into account. However, it is impossible to obtain financial compensation without going through the legal proceedings.
This booklet is therefore there to help you understand and prepare for the procedure: a legal proceedings are a test, which is added to the often painful course of the discovery of meningioma, medical appointments, and especially the operation when it must take place.
Recall, with its fatigue, is a marathon which you must be aware, and which can be recovered perfectly or have irreversible sequelae. Transitional disorders are also sources of suffering. Also, the existence of a meningioma does not always lead to an operation but can be a source, despite everything, of a lot of anxiety of disabling problems. It is in this sense that the association is trying to help people victims of these drugs for, when they wish, requests for compensation can take place as best as possible.
